EXTENSION OF TIME
Unless called in by any Councillor prior to 12 noon on Monday 30th July 2001, staff propose to
approve the following application under delegation.
EBDEN WARD – MELWAYS REF 86 C4 AH
97/2966 – 17-19 MARY STREET, BEAUMARIS
Planning Permit No. 97/2966 was issued on the 19th November 1997 for the construction of four dwellings and associated car parking facilities. Construction of the development is under way, but completion of the development win’ exceed the four years stated Condition 5 of the planning permit.
The Applicant has advised that due to the previous owner being placed into receivership and the delays associated with this process, the development will not be completed within four years.
The development generally complies with Council policy, however with a density of 1:348 it does not comply with Council’s current density policy of 1:400.
Condition 6 of the permit allows for Council to grant an extension of time to the permit provided the request is received before the permit expires or within 3 months of its expiry date. The permit is due to expire on 19th November 2001. Therefore, the request has been received within the time limit.
It is recommended that the permit be extended as follows:
That the permit be extended by a period of 12 months. The permit will therefore expire on 19th November 2002.
